Subject-To (Sub-To)
Buying a property while leaving the existing mortgage in place. We take over the payments but the loan stays in the seller's name until we refinance or sell.
T.O.P. โ Take Over Payments
Our brand name for Subject-To. We take over the seller's monthly mortgage payment so they can walk away without paying it anymore.
Equity
The difference between what the home is worth and what is owed on it. If the home is worth $200k and they owe $150k, they have $50k in equity.
ARV โ After Repair Value
What the property would be worth after all repairs and updates are made. Used to calculate our maximum offer.
Lien
A legal claim against a property for money owed. Examples: mortgage, tax lien, HOA lien, contractor lien. Must be paid or resolved before or at closing.
Title
Legal ownership of a property. Before any sale closes a title company checks that the title is clean โ no outstanding liens, disputes, or ownership issues.
MAO โ Maximum Allowable Offer
The most we can pay for a property and still make the deal work. Formula: (ARV ร 70%) โ Repairs โ Fee.
Probate
A legal process when someone dies and their estate (including property) is distributed. Property in probate cannot be sold without court approval.
Foreclosure
When a bank takes back a home because the owner stopped making payments. Once foreclosure is complete the owner loses the home and takes a major credit hit.
Underwater / Upside Down
When someone owes more on the home than it's currently worth. They have negative equity. T.O.P. is usually the best option here.
Cash Offer
We buy the property outright with our own money โ no bank financing needed. Allows us to close fast, usually in 7-14 days.
Due-on-Sale Clause
A clause in most mortgages that technically allows the bank to demand full repayment if the property changes hands. In practice banks rarely enforce it on performing loans.
